NOTICE OF ORDER ADOPTING THE JOINTLY DEVELOPED VOLUNTARY
INTEGRATED MANAGEMENT PLAN AND ASSOCIATED SURFACE WATER
CONTROLS FOR THE LITTLE BLUE NATURAL RESOURCES DISTRICT
In accordance with Neb. Rev. Stat. § 46-744, notice is hereby given that the Nebraska Department of Natural Resources (Department) on July 15, 2019, issued an Order adopting the voluntary Integrated Management Plan (IMP) jointly developed by the Department and Little Blue Natural Resources District (District) and the associated surface water controls contained within the IMP. The IMP will become effective August 15, 2019.
The outlined contents and chapters of the voluntary IMP are: 1. Authority and Effective Date, 2 Introduction, 3. Legislative background, 4. Public participation, 5. Geography and physical description, 6. Goals, objectives and action items, 7. Integrated Management Plan controls, 8. The Platte River Special Management Area, 9. Monitoring plan, 10. Funding options, 11. Information considered, and 12. Review process and modifications, and Appendices.
A general description of the surface water controls that are included in the IMP and will apply to the entire geographic area of the Little Blue NRD are as follows: 1. Investigation of surface water uses and initiation of an adjudication process if non-use is determined, 2. Continued enforcement of statutes and rules for surface water appropriations, 3. Evaluation of surface water transfers, 4. Required measuring devices on all new high capacity surface water irrigation uses, and 5. Mandatory reporting for all high capacity surface water irrigation uses when a water availability trigger is met.
A general description of the surface water controls that are included in the IMP and will apply to the Platte River Special Management Area, the geographic area of which is described in Chapter 5 of the voluntary IMP, are: 1. Moratorium on new surface water uses, and 2. Variances for new surface water appropriations.
